Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms of Service") carefully before using the MySport.pro website and mobile application (the "Service") operated by BMB ENTERPRISES LTD ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

  • Eligibility: You must be at least 18 years of age to create an account and use the MySport.pro Service. By creating an account, you represent and warrant that you are at least 18 years old.
  • Account Responsibility: When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Public Profile: Please note that your user profile, including your Full Name and Profile Picture, is generally public and visible to other MySport.pro users.

2. Services and Features

MySport.pro provides a platform that enables users to:

  • Create personal profiles.
  • Search for sporting events.
  • Create their own sporting events.
  • Join existing sporting events.
  • Engage in in-app messaging with other event participants.
  • Share photos related to events.
  • Process payments for joining events via our integrated third-party payment processor.

Payment Processing: MySport.pro facilitates payments for joining events through Stripe, our third-party payment processor. We do not directly handle or store your payment card details. All payment transactions are subject to Stripe's terms and conditions and privacy policy.

No Current Paid Features/Subscriptions: At present, all core features of MySport.pro are free to use. We reserve the right to introduce paid features, premium subscriptions, or verification services in the future. Any such changes will be communicated to you with appropriate notice.

3. User-Generated Content (UGC)

  • Responsibility for Content: You are solely responsible for all content that you upload, post, link to, or otherwise make available via the Service, including event descriptions, chat messages, and photos ("User Content").
  • Content Restrictions:
    • All User Content, especially photos and messages, must be event-related and captured by the users themselves.
    • You agree not to upload, post, or transmit any User Content that is illegal, adult/pornographic, violent, hateful, discriminatory, harassing, defamatory, or otherwise objectionable.
    • You must not upload content that infringes upon the intellectual property rights of others, including copyright and trademark.
  • Moderation: We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content that we deem, in our sole discretion, to violate these Terms or be otherwise harmful.
  • Ownership & License of User Content: By uploading or posting User Content to MySport.pro, you retain all your ownership rights in your User Content. However, you grant MySport.pro a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with the Service and MySport.pro's (and its successors' and affiliates') business, including for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

4. Sporting Events and User Conduct

  • Platform Only: MySport.pro is purely a platform designed to connect users for sporting events. We do NOT organize, supervise, or take responsibility for the actual sporting events themselves. The responsibility for the event, its organization, safety, and adherence to rules lies solely with the event host and participants.
  • Rules of Conduct: When using the Service or participating in events organized through the platform, you agree to:
    • Treat other users with respect and civility.
    • Not engage in any form of harassment, bullying, or abusive behavior.
    • Adhere to the rules established by the event host for any specific event.
  • Dispute Resolution Between Users: MySport.pro does not mediate disputes between users. Users are expected to resolve any disagreements or issues amongst themselves.

5. Intellectual Property

  • MySport.pro's Property: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BMB ENTERPRISES LTD and its licensors. This includes our distinctive logo and all bespoke images and design elements on our system.
  • Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use strictly in accordance with these Terms.

6. Termination

  • By You: You may delete your MySport.pro account at any time by navigating to your "My Account" page within the app and selecting the account deletion option.
  • By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Reasons for termination include, but are not limited to, violating these Terms and Conditions, posting prohibited content, engaging in fraudulent activity, or harassment of other users.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimers

  • "AS-IS" Service: Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MySport.pro disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
  • No Endorsement of Events: MySport.pro does not endorse, guarantee, or take responsibility for the quality, safety, legality, or any aspect of events organized through the platform, nor for the conduct of event hosts or participants.
  • Accuracy of Information: We do not warrant that the information available on the Service is accurate, complete, or reliable. We are not responsible for the accuracy of user-posted content, including event details.
  • Service Availability: MySport.pro does not warrant that the Service will be uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; or that the Service is free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall BMB ENTERPRISES LTD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

You expressly understand and agree that MySport.pro holds no liability for any incidents, accidents, injuries, damages, or losses arising from or related to events organized by users through the platform, or the conduct of users at such events. Your participation in any event found or organized via MySport.pro is at your own risk.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
